page-title\">LEGISLATION<\/h1>\r\n                                    <div class=\"page-desc\">\r\n                        <p><p><span style=\"font-weight: 400\">Legislation on Medically Assisted Reproduction (MAR) is considered to be one of the most <\/span><b>liberal<\/b><span style=\"font-weight: 400\"> and <\/span><b>patient-friendly<\/b><span style=\"font-weight: 400\"> in Europe.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">It includes all methods of assisted reproduction techniques such as In Vitro Fertilization (IVF), Intrauterine Insemination (IUI), surgical sperm retrieval (PESA, TESE, MESA), Intracytoplasmic Sperm Injection (ICSI), sperm or oocyte donation cycles, number of embryos for transfer, Preimplantation Genetic Testing (PGT), surrogacy et al.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The Greek law focuses on ensuring that the practice of assisted reproduction techniques is in the best interest of the conceived child.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The first law in the field of Medically Assisted Reproduction was enacted in 2002 (<a href=\"https:\/\/eaiya.gov.gr\/wp-content\/uploads\/2015\/03\/3089_2002.pdf\" target=\"_blank\" rel=\"noopener\">law 3089\/2002<\/a><\/span><span style=\"font-weight: 400\">) <\/span><span style=\"font-weight: 400\">while a second law (<\/span><a href=\"https:\/\/eaiya.gov.gr\/wp-content\/uploads\/2015\/03\/3305_2005.pdf%20\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">law 3305\/2005<\/span><\/a><span style=\"font-weight: 400\">)\u00a0 <\/span><span style=\"font-weight: 400\">regulates MAR treatments.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Since then many improvements in <a href=\"https:\/\/eaiya.gov.gr\/law-fek\/\" target=\"_blank\" rel=\"noopener\">Greek legislation<\/a> in specific fields of MAR have been introduced\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Important intersection for MAR in Greece is the Presidential Decrees that set the terms and conditions for the license to establish and operate Medically Assisted Reproduction Units (MARU\/ MYIA) and Cryopreservation Banks\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The recent law 4958 (<\/span><a href=\"https:\/\/eaiya.gov.gr\/wp-content\/uploads\/2022\/09\/%CE%9D.-4958.2022.pdf%20%20%20\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">law 4958\/2022<\/span><\/a><span style=\"font-weight: 400\">) <\/span><span style=\"font-weight: 400\">\u00a0is considered extremely important because:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">increases the age limit for women up to 54 years old<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">abolishes the exclusive anonymity of the third donor<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">prolong the duration of the cryostorage of the cryopreserved genetic material specimens\u00a0<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<\/p>\r\n                    <\/div>\r\n                            <\/div>\r\n        <\/div>\r\n    <\/div>\r\n<\/section>\r\n\n\n\n<section class=\"reverse m-w-50\">\n\n            <div class=\"ivf-container ivf-small-container section-title-wrap\">\n            <h3 class=\"section-title\">General Issues<\/h3>\n        <\/div>\n    \n (max-width: 922px) 100vw, 922px\" \/>            <\/div>\n        \n        <div class=\"text\">\n            <p class=\"text__desc\">\n                <p>Medically assisted human reproduction is permitted in the case of inability to have children in a natural way or to avoid the transmission of a severe genetic disorder to the child.<\/p>\n<p>The legal framework consents to artificial reproduction for <span style=\"font-weight: 700;color: #b02e85\">cohabiting couples, married couples <\/span>or to an <span style=\"font-weight: 700;color: #b02e85\">unmarried or single woman. <\/span>According to the legislative frameworks in other EU countries, whenever consent to use these techniques is given to single women, it also covers single women who have identified themselves as <span style=\"font-weight: 700;color: #b02e85\">homosexual. <\/span>Such medical assistance in Greece is permissible provided that the assisted person is <span style=\"font-weight: 700;color: #b02e85\">within the reproductive age. <\/span>\u2028\u2028<\/p>\n<p><span style=\"font-weight: 700;color: #b02e85\">Women up to 54 years old <\/span>can have access to Medically Assisted Reproduction after a specific consent and permission from the Greek National Authority of Assisted Reproduction.<\/p>\n<p>For all Assisted Reproduction techniques and methods, in case of unmarried couples or single women, a notarial deed is necessary so that they can have access to the indicated treatment.<\/p>\n            <\/p>\n        <\/div>\n\n        \n    <\/div>\n\n        \n<\/section>\n\n\n       <p class=\"text__desc\">\n                <p><span style=\"font-weight: 700;color: #b02e85\">Consent to all relevant treatments and procedures<\/span> must always be given in a written form and after appropriate information about the risks and consequences of the techniques of artificial reproduction. Gametes, embryos, gestation and relevant intermediations cannot be objects of a contract that involves financial retribution.<\/p>\n<p>The following procedures are <span style=\"font-weight: 700;color: #b02e85\">prohibited: cloning <\/span>of a human being for reproductive reasons and the <span style=\"font-weight: 700;color: #b02e85\">gender selection. <\/span>The latter is allowed only to avoid gender-transmitted hereditary diseases.<\/p>\n<p><span><span style=\"font-weight: 700;color: #b02e85\">Preimplantation genetic testing ( PGT) <\/span>is allowed upon consent and permission from the <a href=\"https:\/\/eaiya.gov.gr\/wp-content\/uploads\/2023\/01\/%CE%A6%CE%95%CE%9A-6549.%CE%92.21.12.20221.pdf\" target=\"_blank\" rel=\"noopener\">Greek National Authority <\/a> of Assisted Reproduction,  in order to prevent certain genetic diseases or disorders from being passed on to the child (PGT-M, PGT-SR or PGT-A). Only frozen semen samples are allowed to be used.<\/p>\n<p>Candidate donors, must undergo clinical and laboratory tests and would not be eligible if suffering genetic or  infectious diseases,  have burdened family history or hormonal disorders. <\/p>\n<p>For oocyte donors IVF Athens Center requests additional tests recommended by the European Society of Human Reproduction and Embryology (ESHRE).<\/p>\n<p>IVF Athens Center does not run their own sperm donors, but we are in cooperation with valid and certified Cryopreservation Banks of male genetic material either in Greece (<a href=\"https:\/\/cryogonia.gr\/en\/ \" target=\"_blank\" rel=\"noopener\">Cryogonia<\/a>) or in Europe ( <a href=\"https:\/\/www.cryosinternational.com\/\" target=\"_blank\" rel=\"noopener\">Cryos International<\/a>, <a href=\"https:\/\/www.europeanspermbank.com\/en-int\" target=\"_blank\" rel=\"noopener\">European Sperm Bank<\/a>, <a href=\"https:\/\/www.ceifer.com\/\" target=\"_blank\" rel=\"noopener\">Ceifer BioBanco<\/a>)<\/p>\n<p>For oocyte donation cycles we can either use oocytes from fresh cycles or vitrified-warmed oocytes. For the second case, we are in cooperation with certified Cryopreservation Banks in Cyprus (<a href=\"https:\/\/www.cryosinternational.com\/\" target=\"_blank\" rel=\"noopener\">Cryos International<\/a>, Cyprus) or in other countries in Europe (Ovobank, <a href=\"https:\/\/www.ceifer.com\/\" target=\"_blank\" rel=\"noopener\">Ceifer BioBanco<\/a>) <a href=\"https:\/\/ovobank.com\/\" target=\"_blank\" rel=\"noopener\">Ovobank<\/a><\/p>\n<p>Until 2022,the identity of the donor of reproductive material was strictly anonymous and could not be disclosed to the persons who want to have a child. Medical information concerning the donor was kept strictly confidential. Access to medical history  information was permissible only for the child\u2019s medical benefit. <\/p>\n<p>Since 2022, there are more options. Donors can be anonymous or non anonymous (open donors) or can be a close blood relative in a lateral line.<br \/>\nFor cases excluding blood relatives  (whereas identity is known), the identity of the child and its parents is never disclosed to the donor and strictly confidential protocols are followed.<\/p>\n            <\/p>\n        <\/div>\n\n        \n    <\/div>\n\n        \n<\/section>\n\n\n\n<section class=\"reverse \">\n\n            <div class=\"ivf-container ivf-small-container section-title-wrap\">\n            <h3 class=\"section-title\">Surrogate Maternity<\/h3>\n        <\/div>\n    \n    <div class=\"ivf-container  section-content-wrap split\">\n\n        \n        <div class=\"text\">\n            <p class=\"text__desc\">\n                <p><span style=\"font-weight: 700;color: #b02e85\">Greek legislation differs substantially from the vast majority of European countries whose legislations prohibit any form of surrogate maternity.  <\/span> The transfer of fertilized ova to another woman and her pregnancy is permitted by court authorization before the transfer.<\/p>\n<p>The authorization is issued after an application by the woman who wants to have a child (\u201ccommissioning mother\u201d), providing, among other, that there is a written agreement between the two parties and is confirmed that the commissioning mother is medically unable to conceive.<\/p>\n<p>\u03a4he surrogate mother should not have exceed the age of 54 <a href=\"https:\/\/eaiya.gov.gr\/wp-content\/uploads\/2023\/01\/FEK-5524-TefxosB-26-10-2022.pdf\" target=\"_blank\" rel=\"noopener\">(1704\/2022,  5524\/\u03a4.\u0392\u2019\/26.10.2022)<\/a>, not undergone more than two caesarean sections and <span style=\"font-weight: 700;color: #b02e85\"> fertilized ova do not belong to her (the surrogate mother).<\/span><\/p>\n<p>For surrogate mothers aged 50-54 years old, in order to protect the wellbeing  of the child to be born, an additional specific consent and permission from the Greek National Authority of Assisted Reproduction is mandatory, based on the evidence of her good health condition.<\/p>\n<p>The agreement must be with no financial benefit for the latter. The law clarifies that the following do not constitute financial gain: a. the payment of expenses involved in the achievement of a pregnancy, the gestation, delivery and post-partum period, and b. any incidental loss of profit by the child-bearing woman because of absence from work, or the loss of remuneration for salaried employment which she has missed because of absence related to the purpose of pregnancy, gestation, labor or post-partum period.<\/p>\n<p>One of the prerequisites for granting the judicial authorization for surrogacy was the fact that both the surrogate mother and the commissioning parents should be obligatorily Greek citizens or permanent residents of Greece. <\/p>\n<p>Following a <span>modification<\/span> of the above provision, the surrogacy is now allowed disjunctively to either applicants or surrogate mothers who have their permanent or temporary residence in Greece, thus <span style=\"font-weight: 700;color: #b02e85\">extending this possibility<\/span> also to <span style=\"font-weight: 700;color: #b02e85\">applicants<\/span> or <span style=\"font-weight: 700;color: #b02e85\">surrogate mothers <\/span> who have their permanent residence <span style=\"font-weight: 700;color: #b02e85\">outside Greece.<\/span><\/p>\n<p>\u2028Under this new regime, <span style=\"font-weight: 700;color: #b02e85\">surrogacy in Greece is open for foreigners as well,<\/span><br \/>\nwhile Greece is one of the few countries worldwide to provide a comprehensive framework to regulate, facilitate and enforce surrogacy all by giving legal protection to intended parents even coming from abroad.<\/p>\n<p>Further information on the surrogacy proceedings in Greece you may find <a href=\"http:\/\/www.greeklawdigest.gr\/topics\/aspects-of-greek-civil-law\/item\/217-surrogacy-proceedings-in-greece-after-the-implementation-of-law-4272-2014\" target=\"_blank\" rel=\"noopener noreferrer\">here<\/a>.<\/p>\n            <\/p>\n        <\/div>\n\n                    <div class=\"image scaleup-anim\">\n                <img loading=\"lazy\" decoding=\"async\" width=\"765\" height=\"1024\" src=\"https:\/\/ivfathenscenter.gr\/wp-content\/uploads\/2023\/08\/regulation-4-765x1024.png\" class=\"attachment-large size-large\" alt=\"\" srcset=\"https:\/\/ivfathenscenter.gr\/wp-content\/uploads\/2023\/08\/regulation-4-765x1024.png 765w, https:\/\/ivfathenscenter.gr\/wp-content\/uploads\/2023\/08\/regulation-4-224x300.png 224w, https:\/\/ivfathenscenter.gr\/wp-content\/uploads\/2023\/08\/regulation-4-768x1028.png 768w, https:\/\/ivfathenscenter.gr\/wp-content\/uploads\/2023\/08\/regulation-4-1147x1536.png 1147w, https:\/\/ivfathenscenter.gr\/wp-content\/uploads\/2023\/08\/regulation-4.png 1240w\" sizes=\"auto, (max-width: 765px) 100vw, 765px\" \/>            <\/div>\n        \n    <\/div>\n\n        \n<\/section>\n\n\n\n<section class=\" \">\n\n            <div class=\"ivf-container ivf-small-container section-title-wrap\">\n            <h3 class=\"section-title\">Postmortem Fertilisation<\/h3>\n        <\/div>\n    \n    <div class=\"ivf-container  section-content-wrap split\">\n\n                    <div class=\"image scaleup-anim\">\n                <img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"1019\" src=\"https:\/\/ivfathenscenter.gr\/wp-content\/uploads\/2023\/08\/regulation-5-1024x1019.png\" class=\"attachment-large size-large\" alt=\"\" srcset=\"https:\/\/ivfathenscenter.gr\/wp-content\/uploads\/2023\/08\/regulation-5-1024x1019.png 1024w, https:\/\/ivfathenscenter.gr\/wp-content\/uploads\/2023\/08\/regulation-5-300x298.png 300w, https:\/\/ivfathenscenter.gr\/wp-content\/uploads\/2023\/08\/regulation-5-150x150.png 150w, https:\/\/ivfathenscenter.gr\/wp-content\/uploads\/2023\/08\/regulation-5-768x764.png 768w, https:\/\/ivfathenscenter.gr\/wp-content\/uploads\/2023\/08\/regulation-5.png 1134w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/>            <\/div>\n        \n        <div class=\"text\">\n            <p class=\"text__desc\">\n                <p>Medically assisted reproduction after the death of the spouse or the partner is permitted only if both of the following requirements are met: a. the spouse or the partner suffered from a disease that either could affect fertility performance or endangered his\/her life, and b. the spouse or the partner had consented via a notary document for post mortem fertilization. Artificial fecundation is carried out not earlier than six months and not after two years from the death of the spouse or partner.<\/p>\n            <\/p>\n        <\/div>\n\n        \n    <\/div>\n\n        \n<\/section>\n\n\n\n<section class=\"reverse \">\n\n            <div class=\"ivf-container ivf-small-container section-title-wrap\">\n            <h3 class=\"section-title\">Cryopreserved Fertilised OVA<\/h3>\n        <\/div>\n    \n    <div class=\"ivf-container  section-content-wrap split\">\n\n        \n        <div class=\"text\">\n            <p class=\"text__desc\">\n                <p>The patients resorting to assisted reproduction should decide in common and declare in written form their desire for the future of the cryopreserved reproductive material.<\/p>\n<p>Any cryopreserved reproductive material that is not going to be used for their own treatment (surplus) could be:<\/p>\n<ol>\n<li><span style=\"font-weight: 700;color: #b02e85\">donated anonymous <\/span>for fertility treatment of other patients that the doctor or fertility unit decides\n<\/li>\n<li>used for research or\u00a0<span style=\"font-weight: 700;color: #b02e85\">therapeutic purposes<\/span><\/li>\n<li><span style=\"font-weight: 700;color: #b02e85\">destroyed<\/span><\/li>\n<\/ol>\n<p> <span style=\"font-weight: 700;color: #b02e85\">According to<\/span> <a href=\"https:\/\/eaiya.gov.gr\/wp-content\/uploads\/2022\/09\/%CE%9D.-4958.2022.pdf\" target=\"_blank\" rel=\"noopener\">law 4958\/2022<\/a>,  cryopreservation can last up to 5 years.
